Probate in Utah

When someone passes away, their estate is settled through probate, the court process for handling assets, debts, and final distributions. It can feel overwhelming, so we guide families through each step with clear timelines, compassionate communication, and practical checklists, helping you move forward without added stress or conflict.

What Is Probate?

Probate is the legal process where the court reviews the will, appoints a personal representative, identifies assets, pays valid debts and taxes, and oversees the final distribution to heirs. When handled well, the probate process brings structure to a difficult time and helps prevent conflict.

At Angel Advocates, we explain everything in plain language, outline what the court will expect, and keep communication steady and simple. You receive a written roadmap and a responsive point of contact so questions are answered quickly and kindly.

What Are the Different Types of Probate?

Utah offers several probate paths depending on the size of the estate, the clarity of the will, and whether the family is in agreement. Choosing the right process can save time, stress, and unnecessary court involvement.

Informal Probate

A simplified option used when the will is valid and there are no disputes. This form of probate is often faster, requires fewer hearings, and is generally less expensive.

Formal Probate

When a will is unclear, contested, or requires closer probate court supervision, formal probate provides more structure, judicial oversight, and scheduled hearings.

Small Estate / Summary Procedures

For estates with limited assets or property already passing to named beneficiaries, Utah may allow small estate affidavits or simplified processes to avoid full probate when possible.

Who Needs Probate in Utah?

Probate is required in Utah more often than most families expect. If a loved one passes away owning assets in their own name, without a trust or clear beneficiary designations, the estate must go through the probate process for the court to transfer property legally. Probate ensures everything is handled correctly, but it can be confusing without guidance.

Families who commonly need Utah probate include:

Families With a Will but No Trust

A will must go through probate court, even if everything is clearly written.

Families Without Any Estate Planning Documents

If someone passes without a will, the court must determine heirs and appoint a personal representative.

Families With Real Estate in the Decedent’s Name

Homes, cabins, rental properties, or land titled solely in the person’s name almost always require probate in Utah.

Families With Debts, Taxes, or Creditors to Address

Probate is the process for validating and resolving outstanding financial matters.

Adult Children Handling a Parent’s Affairs

When bank accounts, investments, or vehicles are not jointly owned or do not have beneficiaries listed.

Blended Families or Families With Conflict

Probate provides court oversight when clarity and structure are needed to prevent disputes.

Families With Out-of-State or Multistate Assets

Utah property often triggers probate even if planning was done elsewhere.

Executors or Personal Representatives Needing Legal Authority

Probate gives the appointed representative the power to act, pay bills, access accounts, and distribute property.

My husband and I were discussing updating our wills and discussed changing from a will to a trust. My husband saw an article in a magazine and was impressed by story of Klea and her husband. He called and requested information. We then started meeting over Zoom with Klea, where we discussed our complicated desires of a blended second marriage where we wanted our children to be treated in a fair and equitable manner after our deaths. Klea was able to provide clarity and understanding to our discussions and we were able to watch videos explaining the legal implications. The process was clear and straightforward and completed in a friendly efficient manner. We would highly recommend them to others who are deciding trust vs. wills.

Klea Harris and her team at Angel Advocates truly were, for me and my family, angles sent to help us in a difficult time. I was not the proactive client that planned well in advance of a dire situation in life. When I reached out to Klea in need of some estate planning in order to address the likely passing of my wife in a not too distant future, Angel Advocates came together for us in a wonderful way. Klea moved items around in her calendar to meet with me the very afternoon of the day I phoned her, and actually came in person to the hospital to meet with me and my wife. Her questions were sincere and full of compassion in helping us make the decisions we needed to prepare for our future. I especially loved the encouragement she offered to us in crafting our communication in the trust to be warm and inviting toward our heirs when they would read the document. They will have a feeling of comfort hearing our personal words to them. Even though Klea and her entire team were leaving town just a day later to go on a planned retreat, they spent late hours preparing our paperwork and met again the next day with us for signing, right before heading out of town. What a wonderful group of individuals who make this process as meaningful as they can.

Planning Brings Peace

Facing the future can feel heavy, but it doesn’t have to. I’ve walked many families through the same worries you may be carrying right now, confusion, conflict, or uncertainty about what comes next. Together, we can turn those worries into a plan that protects your loved ones and brings you peace of mind.

What is probate and when is it required

Probate is the court process to transfer ownership and settle debts. It’s typically required when assets are titled only in the decedent’s name and don’t pass by beneficiary, joint ownership, or a funded trust.

How long does probate take

Timelines vary with assets, real estate sales, creditors, and taxes. Many cases move over several months, with some tasks extending into the next tax year. We set a schedule and keep you informed.

Can we avoid probate

Sometimes. Properly funded living trusts, beneficiary designations, and joint title can bypass court. If probate is already needed, we keep it as smooth and respectful as possible and help you plan to avoid it in the future.
